Recent HUD Occupancy News

On April 4, 2016, HUD released a new memo entitled -  Office of General Counsel Guidance on Application of Fair Housing Act Standards to the Use of Criminal Records by Providers of Housing and Real Estate-Related Transactions

In the last 18 months, HUD has worked diligently to provide information about how owner/agents should react to the Supreme Court decision regarding disparate impact.  This is the fourth publication of HUD guidance explaining the risk of fair housing violations in regard to disparate impact of criminal screening. 

Owner/agents should complete a three-step analysis to determine if current criminal screening has a discriminatory effect on any protected group.

  1. Evaluate whether the Criminal History Policy or Practice Has a Discriminatory Effect

  2. Evaluate Whether the Policy or Practice is Necessary to Achieve a Substantial, Legitimate, Nondiscriminatory Interest and

  3. Evaluate whether there is a less discriminatory alternative

HUD Released New Final Rule Ė Streamlining Administrative Regulations.  On March 8, 2016, HUD released a new Federal Register Notice entitled Streamlining Administrative Regulations for Public Housing, Housing Choice Voucher, Multifamily Housing, and Community Planning and Development Programs

These changes affect both Public & Indian Housing (PIH) and Multifamily Housing programs.  The rule changes introduced in this Final Rule are effective April 7, 2016.  Changes affect Social Security Disclosure Requirements, the Definition of Extremely-low Income, the Definition of Tuition and Fixed Income Verification.

HUD Releases FAQs for Section 8 Contract Renewal.  In December 2015, HUD released responses to Frequently Asked Questions Regarding S8 Contract Renewal.  HUD provided these clarifications in response to questions about the New Section 8 Contract Renewal Guide released in August 2015. The updated Section 8 Renewal Policy Guidebook was released on August 5, 2015. You can find the guide and associated documents on the HUDClips web site:

HUD Publishes Guidance for the use of Arrest Records.  In November 2015, HUD issued HSG Notice 2015-10 Guidance for Public Housing Agencies (PHAs) and Owners of Federally-Assisted Housing on Excluding the Use of Arrest Records in Housing Decisions. 

This followed earlier changes that impacted criminal activity policies such as the memo from Deputy Assistant Secretary (DAS) Ben Metcalf regarding the use of marijuana in multifamily properties, the Supreme Court decision in regards to disparate impact and fair housing and Deputy Assistance Secretary (DAS) Ben Metcalf released a memo entitled, Occupancy Protections for HUD-assisted Households in Properties with Low-Income Housing Tax Credits which discussed termination in response to a residents participation in certain criminal activity.  When developing or updating policies addressing criminal activity, we have to consider this new guidance, plus previously issued guidance included in HUD Handbook 4350.3 R1, C4 and Housing Notices such as HUD Notice 2002-22 - Screening and Eviction for Drug Abuse and Other Criminal Activity - Final Rule, HUD Notice 2012-11 State Registered Lifetime Sex Offenders in Federally Assisted Housing.

HUD Releases New Notice Explaining Equal Access to HUDís Housing Programs Regardless of Sexual Orientation, Marital Status or Gender Identity:  HUD recently released Housing Notice 2015-06 Program Eligibility in Multifamily Assisted and Insured Housing Programs in Accordance with HUDís Equal Access RuleThis Notice provides additional guidance addressing protections in place to ensure equal access to housing opportunities regardless of sexual orientation, gender identity or marital status.
